Terms of Use

These Terms are an agreement between you and Anthony Mawe (“we”, “us”) about your use of the Reserva app and related pages (together, “Reserva”). By creating an account or using Reserva you agree to them and to our Privacy Policy. If you do not agree, please do not use Reserva.

1. Who can use Reserva

You must be at least 18 years old, and old enough to use tobacco where you live, to use Reserva. Create an account only for yourself, give accurate information, and keep your sign-in secure. You are responsible for what happens under your account. Tell us right away if you think someone else has used it.

2. What Reserva is, and is not

Reserva is a personal journal and a directory of lounges and events for adult cigar enthusiasts. It is not a store. We do not sell, ship or arrange the sale of tobacco, and nothing in Reserva is medical, health or legal advice.

3. The app license, and these Terms

The license to use the Reserva app is Apple’s standard Licensed Application End User License Agreement. These Terms cover how you use the Reserva service, your content, and our rules. These Terms are between you and us, not Apple. Apple has no obligation to provide support for Reserva or to answer claims about it.

4. Your account and username

Your username is how other people find you. You may not choose one that impersonates someone else or that is offensive, and we may reject, change or reclaim a username that breaks this rule. A username can be changed once every 30 days. You can delete your account at any time in Settings → Delete my account.

5. Your content

You own what you add to Reserva, including your entries, notes and photos (“your content”). You give us a limited, worldwide, non-exclusive license to store, copy, format and show your content for the purpose of running Reserva, and to the audience you choose. If you mark an entry Friends or Public, we will show it to those people. This license ends when you delete the content or your account, except for copies in routine backups and anything other people have already seen or shared. We will not use your content to advertise Reserva or anything else without your permission.

You are responsible for your content. Only add photos and text that you have the right to use. Do not add other people’s private information, and do not post photos of people without their permission. Never post an image of anyone under 21 smoking.

6. Rules

Do not use Reserva to:

• break the law or help anyone else break it;
• post anything hateful, harassing, threatening, sexually explicit, or that promotes violence or self-harm;
• sell, advertise or ask for payment for tobacco, vapes, drugs or anything else, or send spam or unwanted promotions;
• encourage anyone under 21 to use tobacco, or use Reserva if you are under 18;
• pretend to be someone else, or mislead people about who you are;
• collect other people’s information, scrape Reserva, or interfere with how it works or how secure it is;
• misuse reporting or invitations to bother other people.

7. Reporting, blocking and removal

If you see content or behavior that breaks these rules, report it by emailing support@thereservaapp.com or with the report option in the app where it is offered. You can also block another user. There is no tolerance for objectionable content or abusive users on Reserva. We review reports within 24 hours and remove content, and the accounts of people who post it, when it breaks these rules. We are not required to monitor what people post, but we may remove content, limit who can see it, or suspend or end accounts that break these rules, with or without notice. If we remove your content or account and you think we made a mistake, email us and we will look again.

8. Lounges, events and other information

Lounge and event details, such as addresses, hours and dates, are provided for convenience. They can be wrong or out of date, so please confirm with the venue. Lounges and event hosts are independent businesses. We do not operate them and we are not responsible for what happens at a venue or event. Please smoke and drink responsibly, and never drive impaired. Directions open in Apple Maps.

9. Reserve, our paid plan

Reserve unlocks extra features. It is offered as a monthly plan, an annual plan and a one-time lifetime purchase. Prices and any free trial are shown in the app before you buy. Purchases are made through your Apple ID and are handled by Apple, not by us.

• Payment is charged to your Apple ID account when you confirm the purchase.
• Monthly and annual plans renew automatically unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends, at the price shown for that plan.
• You can manage or cancel a subscription in your Apple ID account settings (Settings → your name → Subscriptions) after purchase. Deleting the app does not cancel it.
• If a free trial is offered, any unused part of it ends when you buy a subscription.
• “Lifetime” means access to Reserve for as long as we offer Reserve in Reserva. Refunds are handled by Apple under its policies.

Reserve features may change over time. If we make a change that takes away something you paid for, we will tell you first.

10. Our property

Reserva, including its design, text, software and name, belongs to us and our licensors. You may use it for your own personal, non-commercial use as these Terms allow, and may not copy or resell it. Cigar and lounge names shown in Reserva belong to their owners, and their appearance does not mean we are affiliated with or endorsed by them.

If you send us ideas or feedback, we may use them without owing you anything.

11. Ending your use

You can stop using Reserva at any time and delete your account in Settings. We may suspend or end your access if you break these Terms or if we must do so by law. When your access ends, your license to use Reserva ends. Sections that by their nature should continue, such as those on your content, disclaimers, liability and governing law, will continue.

12. Disclaimers

Reserva is provided “as is” and “as available”. To the extent the law allows, we do not promise that Reserva will always work, be error-free, or keep your data from ever being lost, and we disclaim all implied warranties, including of merchantability, fitness for a particular purpose and non-infringement. Keep your own copy of anything important to you.

13. Limits on our liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of Reserva. Our total liability to you for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or $100. Some places do not allow these limits, so they may not apply to you fully.

14. Your responsibility to us

You agree to cover reasonable costs and losses we suffer from a claim by someone else that comes from your content or your breaking these Terms.

15. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Before bringing a claim, please contact us so we can try to resolve it informally. Any claim that cannot be resolved this way must be brought in the state or federal courts located in San Antonio, Texas, and you agree to their jurisdiction.

16. Changes and the rest

We may update these Terms. For changes that matter, we will tell you in the app or by email before they take effect, and if you keep using Reserva afterward you accept the new Terms. If part of these Terms cannot be enforced, the rest still applies. If we do not enforce a right right away, we have not given it up. These Terms and the Privacy Policy are our whole agreement with you about Reserva.
